As talks over TikTok’s future in the United States approach another crucial deadline, President Donald Trump has once again shifted the target date. The White House recently announced an executive order titled “Further Extending the TikTok Enforcement Ban,” which now sets a new deadline of December 16. Until this date, the Justice Department is instructed not to enforce a law that could block access to the immensely popular social media platform.

This latest delay coincides with reports suggesting that the US and Chinese governments may be nearing an agreement concerning TikTok. However, experts remain skeptical about the likelihood of a resolution being reached swiftly. Treasury Secretary Scott Bessent noted that preliminary terms had been established, confirming that “commercial terms have been agreed upon.”

Recent discussions reported by the Wall Street Journal indicate that US and Chinese teams are exploring an arrangement where TikTok’s operations in the US would be managed by an investor consortium that includes software giant Oracle. This plan involves moving US users to a new app, currently being tested by TikTok, designed to recreate its content recommendation algorithms. However, it is essential to note that the particulars of this deal are still not finalized and could be subject to change.

On the diplomatic front, Trump is scheduled to speak with China’s President Xi Jinping about TikTok on an upcoming Friday. According to a law enacted in 2024, aimed at addressing national security and privacy concerns, TikTok’s parent company, ByteDance, was required to transfer the service to a US-based company by mid-January 2025. If this does not occur, TikTok would essentially become inaccessible in the US. The app faced a temporary shutdown for US users prior to the first enforcement delay.

Recent executive actions taken by Trump in April and June have restarted the countdown to enforcement, but the road ahead is fraught with complications. Ongoing trade tensions between the US and China, coupled with a recent challenge against the US-based company Nvidia, have further muddied the waters. China claims that Nvidia has contravened its anti-monopoly laws, adding another layer of complexity to negotiations surrounding TikTok.

Despite optimism emanating from the administration about a potential agreement, the reality remains that TikTok’s future may still hang in the balance. Star Kashman, founder of Cyber Law Firm, expressed doubt regarding the likelihood of a deal being completed promptly, given the numerous external factors that often derail negotiations.

Kashman elaborated that many competing interests, including ByteDance’s obligations to the Chinese government, national security considerations, and privacy matters, make reaching a clear consensus increasingly challenging.

Should an agreement eventually be accomplished to ensure TikTok’s continued operation in the US, it might only mark the beginning of a protracted negotiation over the platform’s future. Usha Haley, a professor of management at Wichita State University, remarked that for the Chinese, entering into a deal typically signifies the start of deeper negotiations rather than their conclusion. This sets the stage for intricate discussions that could unfold over several years.

Haley cautioned that any potential agreement would likely undergo rigorous examination by Congress, establishing a precedent for how future foreign apps might operate in the US. The Trump administration would probably insist on stringent conditions, such as US-based data storage and independent oversight, while China’s government might strive to retain its influence over TikTok, ensuring some level of control remains intact.

As the deadline looms, the intricate geopolitical landscape continues to influence the unfolding story of TikTok in the United States, leaving many questions unanswered and making future developments critical to observe.
